Ownership of Content

All music, melodies, lyrics, sound recordings, compositions, arrangements, production elements, artwork, branding, logos, videos, written content, and other materials on this Website are created, written, and produced by Eugene Altman under the artist name Mighty Mood and are the sole and exclusive property of Eugene Altman.

Intellectual Property Rights

This includes, but is not limited to:
  • The Get Me album and all tracks, including Get Me Sleep, Get Me Calm, Get Me Focused Energy, Get Me Awake, Get Me Confident, Get Me Fit, and Get Me Home.
  • All future songs, albums, and creative works released under the Mighty Mood brand.
  • All associated branding, marketing, visual media, promotional materials, and the Mighty Mood and Mighty Mood Music names and logos (claimed trademarks of Eugene Altman).

Prohibited Uses

You agree not to:
  • Reproduce, distribute, adapt, sample, remix, perform, license, sell, or exploit any content without express prior written consent from Eugene Altman.
  • Use this Website or its content for any illegal or unauthorized purpose.
  • Attempt to copy, reverse-engineer, or otherwise infringe upon any of the Website’s protected works or proprietary systems.

Enforcement and Legal Action

Violations of these Terms & Conditions will be pursued to the fullest extent permitted by law, including claims for:
  • Monetary and statutory damages
  • Injunctive relief
  • Recovery of legal fees and costs

Limitation of Liability

Royalties and Rights

All royalties from the sale, streaming, licensing, or public performance of works created, written, and produced by Eugene Altman under the artist name Mighty Mood are the exclusive property of Eugene Altman. Works are distributed via DistroKid and registered with BMI for royalty collection. Unauthorized use of works is strictly prohibited and will result in legal action.

Arbitration and Class-Action Waiver

Any dispute, claim, or controversy arising out of or relating to your use of this Website, our content, or these Terms & Conditions, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Ada County, Idaho, unless both parties agree otherwise in writing. The arbitrator shall have exclusive authority to resolve any dispute, including but not limited to the enforceability or interpretation of this arbitration provision. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Waiver of Jury Trial: You and Mighty Mood Music hereby waive any constitutional and statutory rights to sue in court and have a trial in front of a judge or jury. Class-Action Waiver: You and Mighty Mood Music agree that all claims and disputes shall be arbitrated on an individual basis and not on a class or collective basis, and expressly waive any ability to participate in a class, collective, or representative proceeding. This arbitration agreement shall survive the termination of your relationship with Mighty Mood Music. If any provision of this clause is found unenforceable, the remaining provisions shall remain in full force and effect.

Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the United States and the State of Idaho, without regard to conflict of law principles.

Changes to Terms

We reserve the right to update or modify these Terms & Conditions at any time without prior notice. Continued use of the Website after such changes constitutes acceptance of the new terms.
