DMCA Takedown Policy

Effective Date: August 12, 2025 This Digital Millennium Copyright Act (“DMCA”) Takedown Policy applies to mightymoodmusic.com (the “Website”) and all official Mighty Mood Music platforms. We respect the intellectual property rights of others and expect our users and visitors to do the same.

Our Policy

It is our policy to:
  • Respond promptly to valid DMCA notices of alleged infringement.
  • Remove or disable access to material that is claimed to be infringing, upon receipt of a valid notice.
  • Terminate, when appropriate, access for repeat infringers.

Filing a DMCA Takedown Notice

If you believe that any content on the Website or our platforms infringes your copyright, you must submit a written DMCA notice that includes all of the following:
  1. Your physical or electronic signature.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
  3. Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate the material (e.g., direct URL).
  4. Your contact information, including name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Counter-Notification

If you believe that your removed content is not infringing, or that you have authorization from the copyright owner, you may send us a counter-notice that includes:
  1. Your physical or electronic signature.
  2. Identification of the content that has been removed and its original location before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the content was removed by mistake or misidentification.
  4. Your name, address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal court in your district (or in Boise, Idaho if outside the U.S.) and that you will accept service of process from the person who filed the original DMCA notice.

Repeat Infringer Policy

We reserve the right to disable or terminate access for users who repeatedly infringe upon our intellectual property rights or those of others.

Important Note

Knowingly submitting false DMCA claims may result in legal liability for damages, including costs and attorney’s fees, under Section 512(f) of the DMCA.
